1. This Is an Agreement Between You and WebHero, Inc.
This Agreement ("Agreement") is between you (USER) and Webhero, Inc. and governs your use of any Web site or Web pages operated by WebHero and the purchase of any product or service offered by WebHero.
WEBHERO OFFERS ITS SERVICES CONDITIONED ON YOUR ACCEPTANCE WITHOUT MODIFICATION OF THIS AGREEMENT. YOUR USE OF WEBHERO SITES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT.
2. How WebHero May Modify This Agreement
WEBHERO may amend this agreement at any time, without notice, by posting the amended terms on our web site. You are responsible for regularly reviewing these terms and conditions. Your continued use of the WEBHERO Web Sites after the effective date of such changes constitutes your acceptance.
7. Purchasing or Transferring a Domain Name
By purchasing a new domain name or transferring an existing domain name or by purchasing web hosting, you agree to be bound by these terms and conditions and the Domain Registration Agreement.
You agree to have your credit card automatically charged for the total amount due for WebHero products up to 30 days prior to their renewal date. To avoid automatic charges, products must be canceled at least 30 days before their scheduled renewal. There is no money back guarantee for domain name registrations.
8. Member Conduct
You agree not to use the Service to upload, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You agree not to upload unsolicited bulk or commercial email ("Spam"). Violation may result in immediate account termination.
13. WebHero Makes No Warranty
WEBHERO PROVIDES THE WEBHERO NETWORK OF WEB SITES "AS IS," "WITH ALL FAULTS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBHERO PARTIES MAKE NO REPRESENTATIONS, WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED.
24. Resolution of Disputes
For the adjudication of all disputes concerning or arising from the service and facilities provided under this agreement, all litigation shall be commenced in a state or federal court sitting in Oklahoma County, Oklahoma. This venue selection clause is mandatory.
26. Secure Certificates
Each Website hosted by WebHero is required to have a Secure Certificate (SSL). WebHero will automatically install a Certificate on your site and bill you our retail rate if you haven't purchased one. This is not an option and is a requirement.
